No Fault Workers’ Compensation System

As a “no fault” system, Massachusetts workers’ compensation seeks to protect both workers and their employers. It does so by requiring employers to establish and pay for workers’ compensation insurance for the benefit of workers who suffer work-related injuries, while at the same time prohibiting injured workers from suing their employer or co-workers for personal injury damages known as “pain and suffering.”
